Two events characterized the start of this legal week:
The actors’ Cvrtnicek and Potmesil affair seems to be prima facie quite clear, the law, without any question, was broken. But I do not think that the real perpetrators were the actors. They, as actors, were only following the script that was written a given to them by someone else, and since the case here is not a felony one like, say, a murder, it is not for them to scrutinize legal consequences of the performed action. Here, the actors played their roles like puppets on the strings pulled by the director, who is the one who is fully responsible for the legality of actions performed by his actors.
To the other case (Communist Semelova testified in police), the additional explanation is offered by Jachymov denier Marta Semelova. It is true that it is quite silly to argue with the police (about anything), but since Semelova started this, it would be worth to keep an eye on this case. I do not expect that Jan Petrasek’s Communist bosses allow him to ask for her extradition – prosecution departments are full of Communists on all levels – but if against all adds such an improbable accident really happens, we may witness very interesting debate in the Assembly and then equally valuable vote that could show us who really respects freedom of expression and who support freedom of speech only for ideas he/she agree with (that, as we know from Noam Chomski, is not freedom of speech at all).
But, the most interesting here could be the view of ODS which slowly starts to grew out of confines of “Klausism” with its contempt for law and lawyers, but still cannot comprehend, that the independent justice system is better than is the justice under the boots of politicians, because such a system on one hand could not be used for our own political interests, but on the other, our political enemies could not use it against us if, or when, they eventually take our places. Lesson “Necas” was quite valuable here, let’s hope, that some our ODS representatives, able of at least basic analytical thoughts, shall analyze what happened here, and use it for common welfare of our future.
