Ing. Marek Gába:„This is how representatives of the Civil Criminal Procedure Code and their elected experts work in Ostrava. Where is the defendant's right to a fair trial, to which he, as a citizen of the Czech Republic and the European Union, is entitled under the Criminal Procedure Code, the Constitution of the Czech Republic, the Charter of Fundamental Rights and Freedoms and the European Convention on Human Rights? The judge violates the principle of equality of arms by undermining my guaranteed procedural rights to a fair trial with the consent of the prosecutor present.

If you are interested in my case, I am ready to supply you with all the documents I have for this case, so that similar excesses do not recur, or at least to minimize as much as possible. The saddest thing is that most people do not have the opportunity to defend themselves against these "dirty practices" of the Code of Civil Procedure, for example for financial, time, psychological, etc., or they are content to get only a condition, even if they are innocent. And this is exactly what people like MUDr. Dvořáček, who is also a member of the Department of Intensive Care Medicine, Emergency Medicine and Forensic Sciences at the Faculty of Medicine of the University of Ostrava, operates forensic medicine, so he teaches his future successors. Maybe it would be good to revise his previous expert opinions. It would certainly help many people."

Convicted Marek Gába wrote all individual violations of the Code of Civil Procedure: Police of the Czech Republic Ostrava (in  21 Points, 50 official records are missing), District Public Prosecutor's Office Ostrava (13 Points), District Court Ostrava (31 Points), MUDr. Igor Dvořáček - large producer of expert opinions (4 Points). 

Only 69 times the violation of the Code of Civil Procedure made it possible to convict an innocent person. You can read the entire statistics of the conscious, criminal conduct of those who have to abide by the law HERE !!!

It is no wonder that the European Court of Human Rights has declared the Czech judiciary is dysfunctional, violating national law on a „knife edge“ (The Robert Tempel case June 2020).

His criminal prosecution was stopped by the Supreme Court's RESOLUTION and the verdict of the KS Ostrava was cancelled. The resolution was received on 13.6.2024. 4 cases were objected, in two of them the Supreme Court upheld. They wrote it in a "charlatan" way, even if he had been convicted, it would have been a small sentence anyway, which he had already served because of the slander.  They just made it so when the property and non-property damage is recovered it won't be too much. In the current Czech context, that's a success. The appeal against the accused was also filed by the Supreme Court under the leadership of JUDr. Igor Stříž (former member of the Communist Party of Czechoslovakia). He proposed that the Supreme Court of the Czech Republic reject the appeal of the accused as manifestly unfounded. He agreed that the Supreme Court should decide in closed session.

It will recover compensation for seven years of delays from KS Ostrava. Psychological and physical harm and damage to health can be claimed. Legal costs should be paid by his ex-wife. He also had to pay 70,000 CZK to her lawyer Rybář. That's for years again. The Ostrava "Judicial Palermo" will hardly repent, including Judge Jana Bochňáková. She convicted ing. Marek Gaba to 5 months! She should be immediately stripped of her judicial robe as one of the greatest disgraces in the history of Czech justice.
